Donald Countryman was arrested on November 29, 2004 for unlawful possession of a firearm by a felon. On July 6, 2005, appellant filed an application for writ of habeas corpus seeking dismissal under article 32.01 of the code of criminal procedure because the State had not obtained an indictment by the next term of court. See Tex. Code Crim. Proc. Ann. art. 32.01 (Vernon Supp. 2005). The State obtained an indictment on July 14, 2005. The trial court conducted a hearing on the application for writ of habeas corpus on July 22, 2005, and denied relief by written order on September 8, 2005. Appellant contends on appeal that the trial court erred in denying relief. We reverse the trial courts order denying habeas corpus relief and order the indictment dismissed.
